TERMS AND CONDITIONS OF USE OF WAGO.ltd.uk

1. GENERAL
WAGO.ltd.uk is operated by WAGO Limited.
Office opening hours are 8.45am to 5.00pm Monday to Friday (closed bank holidays).

2. ACCEPTANCE OF TERMS
Your access to and use of WAGO.ltd.uk ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

3. INFORMATION
The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision. WAGO Limited shall use its best endeavours to ensure that all information is correct, but shall not be under any liability for any damage, loss or expense resulting from any errors or omissions. Goods supplied may vary in detail from the illustrations and descriptions, (which are approximate and for guidance only) as a result of improvements and modifications.

4. CHANGES TO WEBSITE
WAGO.ltd.uk reserves the right to:
4.1) change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that WAGO.ltd.uk shall not be liable to you for any such change or removal; and
4.2) change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

5. COPYRIGHT
5.1 All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to WAGO.ltd.uk or otherwise used by WAGO.ltd.uk as permitted by law.
5.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

6. DISCLAIMERS AND LIMITATION OF LIABILITY
6.1 The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
6.2 To the extent permitted by law, WAGO Limited will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
6.3 WAGO Limited makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
6.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of WAGO Limited for death or personal injury as a result of the negligence of WAGO Limited or that of its employees or agents.


7. REFUSAL OF SERVICE
WAGO Limited reserves the right to refuse supply of any goods to any person or any company for any reason.




8. PRICES
Whilst every endeavour is made to ensure prices are correct WAGO Limited reserves the right not to supply goods which are found to be incorrectly priced. In this event you may reconfirm the order upon price amendment or cancel the order and receive a full refund.


9. AVAILABILITY AND DELIVERY
WAGO shall not be liable for any loss arising from items being out of stock, or arising from problems with delivery including late, incomplete or damaged items. Claims for incomplete or damaged items must be made, in writing via email within three days of delivery. Any delivery period is an estimate only and commences from the seller’s acknowledgement of the purchaser’s order.

10. GUARANTEE
a) The Seller guarantees as its discretion to refund the price of the goods or to repair or replace free of charge any of the goods found to its satisfaction to be defective within 24 months of the date of delivery owing to faulty design, materials or workmanship, provided that notification of any defect is given to the Seller immediately upon it becoming apparent to the Purchaser, the goods have not been modified of repaired other than by the Seller and have been used, installed, operated, stored and maintained normally or within the Seller's recommendations for use.
b) Goods returned under this guarantee shall be delivered to the Seller's premises at the Purchaser's expense and if found not to be defective (or when the defect is attributable to the Purchaser's design or materials) will be returned to the Purchaser at its expense and subject to a testing charge of 15% of the invoice price together with VAT thereon if applicable.
c) The Seller's obligation herein to refund repair or replace the goods is the sole liability of the Seller as regards the quality, fitness or description of the goods and their correspondence with sample. All other representations warranties conditions are excluded save where not capable of exclusion at law. The Seller is under no further liability in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from or in relation to the quality fitness or description of the goods and their correspondence with sample, however the Seller accepts liability for death or personal injury arising out of its own negligence.
d) The Seller will not operate the guarantee contained in Clause 10 (a) hereof in the case of distortion, contamination or lightfastness of plastic mouldings unless stored under conditions and in packaging recommended by the Seller and plastic mouldings will not be packaged by the Seller for storage unless agreed at time of order.
e) The Seller shall not be liable for loss or profit, or any economic loss arising from any defect in the goods, breach of contract or liability in tort.
f) The goods shall not be considered defective for the purposes of these Conditions unless:-
1. They are not in accordance with the Purchaser's specification where this is the agreed specification.
2. If the Purchaser has no such specification or to the extent that the Purchaser's specifications is silent as to any aspects of the design, function, performance, tolerances, quality or characteristics of the goods the goods do not confirm to the Seller's published information or if no such information has been published the goods do not conform to the standards which the Seller considers normal or usual or products of the kind sold at a similar price. The seller is not in a position to ensure the Purchaser's specification is correct and/or sufficient for the purpose intended by the Purchaser and the Purchaser must satisfy itself on this point. The Seller shall not be deemed to have knowledge of the particular purpose for which the Purchaser requires the goods.
g) In the case of goods repaired or replaced by the Seller the guarantee shall terminate at the end of the original guarantee period.

11. OUR CONTRACT
When you place an order to purchase a product from WAGO Limited, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we dispatch that product to you.

12. INDEMNITY
You agree to indemnify and hold WAGO Limited and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against WAGO Limited arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

13. SEVERANCE
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

14. FORCE MAJEURE
WAGO Limited shall not be liable for any default due to any act of God, war, short fall of manufacturer, strike, lock outs or other industrial action, difficulties in obtaining labour or parts, government or other restriction or regulations or other event beyond the reasonable control of WAGO Limited.


15. LAW
These Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales, hereby submit to the exclusive
jurisdiction of the English courts.

16. Data Protection
Certain information not available from the WAGO group server, can only be retrieved from external links. This external information was checked prior to linking the sites. The contents are subject to change beyond our control. Should you feel that any information contained in the external sites violate applicable laws or have inadequate information, please contact us immediately.

WAGO Limited makes every effort to give concise, current and complete information on this website. Changes can be made at any time and without notification. We shall not be held responsible for any errors found in our website. This is also valid for any references within our website, such as "Hyperlinks" that are offered either directly or indirectly in the WAGO website. WAGO cannot be held responsible for any contents from external links or references made by the WAGO website. Furthermore, WAGO cannot be held responsible for any direct or indirect damages (including lost profits) due to information received from any external sites.
The content of the WAGO website is copyright protected. WAGO will permit specific data from the website to be copied and saved for business or personal use if needed. Forwarding any of this information to a third party is forbidden. Any pictures or graphics from the WAGO website are copyright and cannot be saved or copied.

3.1 Survey and edit personal data
A log is opened upon entering the WAGO website which will save statistical information (such as the amount of entries) and any error paths. Any information saved for statistical reasons, will be done anonymously. Any additional assessments of the data will need to be agreed upon.
Personal data will only be saved when specifically received, for example any requests made. Each entry made on the pages has a specific reason, for example to complete your request for information.
If specific information is requested in certain sites, please note that this information is not being entered into a secured area of the internet and can be used without your knowledge. In closed areas of the website, the data is secured.
We do not forward any of your personal data to third parties.

If an e-mail is sent to us, we will use your e-mail address only to correspond with you. Your e-mail address will not be forwarded to any third party.
